Before the sale of the property of the East Penn Iron Co., and therefore the raising of the fund, which you are to distribute, application was made to the Court of Common Pleas of Berks County to open the judgment obtained upon the mechanics' lien, and permit the Railroad Co. to make defense. This petition is still pending, and until it is decided no distribution can be made, because the record of the lien discloses the proceedings to have the judgment opened.
We therefore suggest that the distribution of the fund be suspended pending the determination of said proceedings in Court.
