1870 Antique English Indenture Conveyance Trowbridge Wiltshire Eight Houses New Buildings Dursley Lane John Taylor Rowland Rodway to Simeon Saxty Victorian Property Deed Wax Seals

Approximately 23" by here is a substantial original hand-engrossed Victorian indenture on vellum/parchment, dated 8th October 1870, recording the Conveyance of Eight Houses and Gardens, being Nos. 14 to 21 New Buildings, Dursley Lane, Trowbridge, Wiltshire, from Mr. John Taylor, Builder, and Rowland Rodway, Gentleman, both of Trowbridge, to Mr. Simeon Saxty, also of Trowbridge. The total purchase consideration is £530, confirmed by two separate receipts endorsed on the document — £400 acknowledged by Rowland Rodway and £130 by John Taylor — both signed in the presence of William J. Mann, Solicitor, Trowbridge.

The indenture opens with a recital of the prior title history, referencing an Indenture bearing date the 17th day of July 1869 (between John Sargeant of the second part and John Taylor of the third part, and Samuel Saxty of the fourth part), under which the piece or parcel of land and hereditaments hereinafter described were granted, confirmed, and conveyed to John Taylor and his heirs for such estates and in such manner as Taylor should appoint, with remainder to the use of James Green his executors and administrators during Taylor’s life in trust, with ultimate limitation to the use of Taylor’s heirs and assigns forever.

A further recital cites an Indenture of Mortgage dated 23rd November 1869 (between John Taylor of the one part and Rowland Rodway of the other part), in consideration of the sum of £350 lent and advanced to Taylor by Rodway, under which the premises were appointed and granted to the use of Rowland Rodway his heirs and assigns for ever (subject to redemption). A subsequent agreement resolved that the outstanding sum of £Four hundred pounds (the residual mortgage balance with additional advances) was due and the parties contracted for the sale and discharge of the same.

The Witnesseth clause recites that in pursuance of the said contract, and in consideration of the sum of One hundred and thirty pounds paid by Simeon Saxty to John Taylor (together with the £400 paid to Rodway, making the total purchase money of £530), Taylor and Rodway jointly grant, release, and convey to Simeon Saxty:

All that piece or parcel of land situate lying and being in Dursley Lane in the Parish of Trowbridge, containing by admeasurement one rood and twenty perches (more or less), bounded on the North by land of George Dainton, on the West by land formerly of Edward Horlock Mortimer Esquire (but now belonging to William Stancomb Esquire), on the East by the road leading from Dursley to Trowbridge, and on the South by property formerly belonging to John Applegate; being the land on which the said John Taylor had recently erected the buildings known as Nos. 14 to 21 New Buildings — eight newly built dwelling houses with gardens.

And also All those eight messuages or dwelling houses with the gardens thereunto belonging, containing by admeasurement one rood and twenty perches (more or less), situated at Middle Studley in the parish of Trowbridge — identified on the Tithe Apportionment Map for the parish as formerly part and parcel of a close of ground numbered 165.

The To Have and To Hold clause conveys the premises to Simeon Saxty and his heirs discharged from the said sum of £Four hundred pounds and all interest and claims thereunder. Rowland Rodway hereby declares that if he shall die leaving a widow, such widow shall not be entitled to dower out of the said premises. Full covenants for title and freedom from incumbrances are given by both Taylor and Rodway.
